OUTLINE OF MAJOR CONTRACT ITEMS

I. Procedural Elements of the Agreement

A. Recognition Clause - Association officially recognized as the sole bargaining agent for ALL lay teachers

B. Grievance Procedure

1. Filed at your school when you feel the administration has violated your contract.

2. Ends in binding arbitration to an impartial arbitrator.

C. Use of due process procedures of the Catholic Church to cover areas not covered by the grievance procedure.

D. Association guaranteed rights to have meetings and distribute information.

II. Teacher Security

A. Clarification of teacher competency

1. No need for state certification

2. Full time and part-time teacher defined

B. Seniority

1. Based on length of continuous service to the school. Calculated from date of hiring.

2. Constriction to be done in order of seniority in area to be constricted.

C. Tenure

1. Tenured granted after specified period of time.

2. Tenured teachers shall not be discharged except for reasons of serious and/or public immorality gross insubordination, incompentence or serious neglect of duty.

3. Evaluation procedures established with sufficient protection for non-tenured teachers.

D. Protection against being replaced or displaced by nuns or priests.

E. Access to, and information kept, in personnel files is strictly limited.

F. Guaranteed right in determining teacher assignments as to subjects taught and scheduling.

G. Guaranteed right to be informed of openings in the school and other pertinent information.

H. Non-discrimination for union activity.

I. Definition of the manner in which a teacher may be disciplined.

III. Teaching Conditions

A. Maximum number of school days set.

B. Maximum length of school day set.

C. Required number of meetings outside of the school day set.

D. A guaranteed number number of preparation periods set.

E. A guaranteed duty-free lunch period each day.

F. No substituting without compensation.

G. No more than three preparations (teacher assignments).

H. Maximum consecutive minutes of teaching and/or service time set.

I. Teachers not required to teach outside field of competency.

IV. Benefits

A. Sick Leave

1. Ten (or more) days a year.

2. Unused sick leave accumulated indefinitely.

3. Unused sick leave reimbursed at retirement.

B. Personal days

1. Two (ore more) per year.

D. Funeral days
Pregnancy Leave

E. Child Rearing Leave

F. Sabbatical Leave at half-pay.
